1.Introduction

Welcome to Find my Locals.

This page tells you the terms on which you may use our website www.findmylocals.com (including all landing pages and social media pages) (together, known as the “site”), whether as registered user or guest. Please read carefully before use.

By using the site, you accept the terms and agree to obey them. If you don’t accept them, please don’t use the site.

2.Who We Are

The site is at www.findmylocals.com, and is operated by Find My Locals. The address for Find My Locals is “find my locals” Kemp House, 152 – 160 City Road, London EC1V 2NX

These terms and conditions apply equally to any landing page or social media page operated by us.

3.Use of the Site

You have permission for temporary use of the site, but we can withdraw or change our service at any time without telling you and without being legally responsible to you.

You must treat all identification codes, passwords and other security information as confidential. If we think you have failed to keep confidentiality, we are allowed to disable any security information (including your passwords and codes).

If you allow anyone else to use our site, you must make sure that they read these terms first, and that they follow them.

Only use the site as allowed by law and these terms. If you don’t, we may suspend your usage, or stop it completely.

We frequently update the site and make changes to it, but we don’t have to do this, and material on the site may be out-of-date. No material on the site is intended to contain advice, and you shouldn’t rely on it. We exclude all legal responsibility and costs for reliance placed on the site by anyone.

By using the site, you agree to us handling this information and confirm that data you provide is accurate.

4.Intellectual Property Rights

We are the owner or licensee of all intellectual property rights in the site (for example the copyright and any rights in the designs) and in any of the material posted on it. They are protected by copyright.

You are allowed to print one copy and download extracts of any page on the site for your personal reference, but not for commercial use without a licence from us. You must not alter anything, or use any illustrations, video, audio or photographs separately from the text that goes with them.

If you breach these terms, you lose your right to use our site, and must destroy or return any copies you have made. The continued use of intellectual property rights, content and any other data and copyright material shall not constitute an infringement or breach of contract where such use arises as a result of our continued use and supply or printed materials being advertised.

5.Disclaimer

We offer a unique advertising opportunity and promote up to a maximum of six local tradespeople/businesses per page as premium trades and trusted traders through the site in specified categories of trade in specified geographical areas (“The Service”)

We reserve the right to reject, remove or amend information or material provided by local business advertisers which has been submitted to us for inclusion if we feel it to be distasteful, defamatory, illegal, does not meet our standards or it breaches any copyright or other rights of any third party.

You agree to indemnify us for any loss we suffer as a result of any action brought against us as a result of your entry on the site, the material contained therein or any service or product supplied by you. We do not accept any liability for any feedback posted on the site from people who engage you through the site.

6. Member Conditions

By submitting your membership fee for the Service, you agree that the information you provide us upon registration, whether by telephone, email or by any other means of communication, is full and accurate and not misleading or untrue in any way.

Each registration is for a single user or business only.

You acknowledge that service levels are paramount to the success of our mutual businesses and therefore agree to adhere to the Find my locals ‘Code of Conduct’.

7. Fees

The full Annual or Monthly Membership Price will show first, then if applicable, Bundle discounts will be added to the cart.
The fee for your membership to the site is payable through a one-off fee paid annually, or a monthly subscription payment. We shall delete your advert without prior notice if payment is not received. If findmylocals increases the annual fee in the future, we will NOT provide you notice. Price changes will take effect at the start of the next membership subscription period following the date of the price change. By continuing to use the findmylocals Service after the price change takes effect, you accept the new price.

If you have subscribed to our annual plan and you cancel your advert within those 12 months. There will NOT be any subscribed financial reimbursements.

Our monthly flexible option  allows you to, if you so wish to stop your monthly payments for any reason, anytime. Without any financial penalties. There is no reimbursement whatsoever of your last payment if you should cancel your monthly payment anytime within that monthly time period.

Bundle Discount:-    If you  advertise in multiple towns or have multiple businesses, You will receive our Bundle discount So, for 2 towns you will receive a 10% discount off the price. For 3 towns you will receive a 15% discount off the price. For 4 towns you will receive 20% discount off the price. For 5 towns and more you will receive the maximum 25% of the price.

We reserve the right to withdraw this pricing offer at any time.

The price for your membership shall be as advertised on the site at the time you make a purchase for a membership. If you cease to make membership payments, you will lose access to the site.

8. Our Obligations

We undertake to you that there will be no more than six premium entries on our Gold Page, our Silver page and Bronze page at any one time, per town in the category within your geographical area selected for your business upon registration for the Service.

Both parties agree that it is in our mutual interest that the name and brand of Find My Locals along with its members and advertisers are both recognised as respected in the public eye. You also agree and understand that it is in all stakeholder’s interest for us to be able to remove from the site any member who is undesirable, dishonest, unreliable, unqualified or otherwise brings the good name of Find My Locals into disrepute or adversely affects the development of the business; such decisions shall be at our absolute discretion.

9. Warranties

We undertake to use all reasonable skill and care in making the Service and the site available to you and your customers whilst ensuring its availability during your membership. Find My Locals cannot guarantee but aims to ensure our site is operational 24 hours a day, although we may be required to suspend access to the site at any time without notice, for whatever reason, e.g. maintenance of site.

Due to the nature of the internet, errors and omissions can and do occur and we do not give any other warrantees in respect of the Service and the site. You agree that the accuracy of information should be verified to ensure the integrity of the site and Service.

We make no warranties that the site is free from infection by viruses or anything else that has either contaminating or destructive properties, accept that our site is regularly monitored for any such matters.

All implied warranties are excluded from this agreement to the extent that they may be excluded as a matter of law.

10. Limitation of Liability

We do not guarantee the accuracy of material on our site. As far as legally possible, we exclude legal responsibility for the following:

·         Any loss to you arising from use of our site

·         Loss of income, profit, business, data, contracts, goodwill or savings

We also exclude, as far as legally possible, all terms and warranties or promises implied by law or by statutes.

We don’t exclude legal responsibility for death or personal injury owing to our negligence, or legal responsibility for fraud or fraudulent misrepresentation, or for anything else where exclusion is not allowed by the law.

We will use all our reasonable endeavours to remedy any faults in the site and the Service, but cannot accept any liability or responsibility for any mistakes or omissions. If you feel that we are in breach of terms and conditions, you agree that your recovery shall be limited to the amount equivalent to your membership fee paid or payable for the current year of Service use.

11. Reservations

We reserve the right to expand, amend or revise the site and indeed the Service as our business grows or as the wider market and business environment demands.

Should any provision in these terms and conditions be found by any court or authority to be invalid or not binding, we agree that such provision shall be severable and discounted from the rest of these terms and conditions which will remain unaffected and fully in force.

Neither party shall be liable for any failure to perform our obligations hereunder, if such failure results from force majeure or other causes beyond reasonable control but shall not include failure caused by negligence, misfeasance or the financial condition of either party.

12.Uploading to our Site

Material that you upload will be regarded as non-confidential and not owned. This means that we can copy it, distribute it, and show it to other people for any purpose. You agree that if anyone else claims to own the material, or says that it breaches their rights, we can give them your identity.

We won’t be legally responsible to anybody for the accuracy of material that you upload to the site, and we can remove it at any time.

13.Computer Offences

If you do anything which is a criminal offence under a law called the Computer Misuse Act 1990, your right to use the site will end straightaway. We will report you to the relevant authorities and give them your identity.

Examples of computer misuse include introducing viruses, worms, Trojans and other technologically harmful or damaging material.

You must not try to get access to our site or server or any connected database or make any ‘attack’ on the site. We will not be legally responsible to you for any damage from viruses or other harmful material that you pick up via our site.

14. Links From Our Site

Links from our Site Platform to other websites are for information only. We don’t control them and don’t accept responsibility for other websites, or any materials found upon them or any loss you suffer from using them.

15.Variation

We change these terms from time to time and you must check them for changes because they are binding on you.

16. General

We may transfer and/or assign our rights and/or our obligations under these terms and conditions and this will not affect your rights. You may not transfer any of your rights or obligations under these terms and conditions.

If you breach these terms and conditions and we ignore this, we will remain entitled to use our rights and remedies at a later date or in any other situation where you breach these terms.

The terms and conditions, together with the privacy policy and any additional terms of the Service, represent the entire terms agreed between us in relation to its subject matter.

17.Applicable Law

The parties will use their best efforts to negotiate in good faith and settle any dispute that may arise out of or relate to this Agreement or any breach of it. Any dispute shall not affect the parties’ ongoing obligations under the Agreement. The English courts have the only right to hear claims related to our site, and all disputes are governed by English law.
